  • By using our Group Spending feature, you agree to these terms and conditions. If you don’t agree, you must not use this feature.
  • You should only use Group Spending with people that you know and trust. In the event of a suspected unauthorized payment, you must contact us without delay. Delayed notification could lead to liability for the entire payment amount.
  • If you have any complaints about us or our features, you may contact us following our complaint procedure.

1. About these Terms

1.1 These Group Spending terms and conditions (“Terms”) apply to personal customers who use our Group Spending feature, whether as an Owner or Member, as detailed in these Terms. By creating a Group, the Owner agrees to these Terms. By using the Group Spending feature, each Member agrees to these Terms. In each case, these Terms describe each party’s rights and obligations, and form a legally binding contract governing the use of this feature. The Terms refer to and incorporate by reference the following documents (the “Additional Documents”), which also apply to your use of the Group Spending feature, including: our Privacy Policy, Customer Agreement, Acceptable Use Policy and Fees and Pricing, and such other agreements referred herein.

1.2 Capitalised words shall have the meanings set forth in the Additional Documents, except as set out below or otherwise defined in brackets within these Terms:

  • Card means a card issued on a Wise Account, either for your Main Account or Group.

  • Group (or Group Spending) means a feature that enables you to separate funds, give individuals you invite (such as friends or family) access to those funds and the option to have a dedicated card to spend those funds.

  • Member means a person that you have invited to, and who has joined, a Group to access and spend the Group’s funds. A Member must be a Wise customer authorized to access, use or operate a Wise Account.

  • Owner means you, the individual that is the legal owner of the Wise Account, and who creates a Group.

  • Permissions means a custom set of settings that control what the Owner and each Member can see and do on the Wise Account.

  • Wise Account means a multi-currency account held by customers at Wise, which includes the Main Account, which may also be referred to as the Current Account, and may include a Jar(s) or Group(s).

2. What is our Group Spending Feature and How does it Work

2.1 Group Spending is a feature designed for Wise customers who wish to share and spend funds with other Wise customers, such as friends or family, by separating funds into a Group and allowing Members of the Group to spend those funds.

2.2 This feature is connected to your Wise Account and enables the Owner and any Member to share funds for expenditure purposes. Members can only access the Group if they have been invited and their access and what they can see are limited to the Permissions the Owner grants them.

2.3 The Owner has all the Permissions over the Wise Account and any Group.

2.4 The Owner can add Members to a Group by invitation. Each Member must be first added to the Wise Account. The Permissions that a Member has been granted will determine what they can see and do as a Member in the Group. Owners may restrict a Member's access to view, and spend Group funds.

2.5 These Terms allow the Owner and Member(s) to receive a Card linked to the Group (in accordance with our Wise Card Terms), link it to their wallet such as Google Pay or Apple Pay, make in-store or online payments and make ATM withdrawals.

2.6 Group Spending is not a joint account. The Owner remains the sole proprietor of the funds at all times. All transactions made through the Group will be deemed to have been made by the Owner. The Owner is fully responsible for all transactions carried out by Member(s) via the Group.

2.7 If the Wise Account is suspended or closed in line with our Customer Agreement, the Member(s) may have reduced access or may not be able to access the Group.

2.8 If the Owner or Members do not recognize a transaction, only the individual who made the transaction can file a dispute. For clarity, the Owner cannot dispute transactions made by any Members because the Owner has authorized each Member to make purchases using Group Funds. Members cannot file disputes for transactions made by the Owner or other Members.

2.9 All spending and withdrawals are subject to any limits referred to in the Customer Agreement.

2.10 The Owner and Members can see all the transactions in the Group.

2.11 The Owner is solely responsible for any form of misuse of the Group Spending feature. The consequences of any form of misuse of the Group, including where either the Owner or a Member engages in fraudulent activity, shall be as set out in the Customer Agreement. By using the Group Spending feature, the Owner agrees that Wise will not be a party to, nor liable for, any claim or dispute that may arise between the Owner and a Member in relation to the use of the Group Spending feature.

2.12 Wise reserves the right to add or remove functionality from the Group Spending feature at any time. Notice will only be provided if the removal of a feature impacts the terms of the Customer Agreement, in accordance with the prescribed notice period.

3. Owners’ Rights and Obligations

3.1 The Owner can create or be a Member of multiple Groups, up to a maximum of four (4) total Groups, inclusive of Groups created by the Owner and Groups of which the Owner is a Member. A Group may be shared only with Members who reside in the same country.

3.2 The Owner can open and close the Group at any time and without notice. A Member cannot oppose this decision.

3.3 If a Group is closed, any Card linked to the Group is cancelled and the fee for any physical Card will not be refunded. When a Group is closed, any remaining funds in the Group are transferred back to the Owner's Main Account.

3.4 The Owner can add or remove Members of the Group.

3.5 The Owner must inform Wise of any event that could have a legal or financial impact on the Group. In the event of a court order or other legal process, such as insolvency proceedings, seizures, or garnishments, we may be required to take certain actions in line with the Customer Agreement. Such actions may include, but are not limited to: placing a reserve or limitation on the Group or releasing the funds on it.

3.6 The Owner is responsible for any taxes that may be due by them as a result of using the features, and it is the Owner’s responsibility to collect, report and pay the correct tax to the appropriate tax authority.

3.7 The Owner controls each Member’s Permissions. Granting Permission to any Member does not relieve you of your responsibilities under these Terms or the Additional Documents, including notifying us if your Wise Account has been compromised or if a transaction is suspected to be incorrect or unauthorized. No Member is able to change the Permissions of the Owner.

3.8 Only the Owner will have the ability to enable the Interest feature within the Group. When you enable and use the Interest feature for Group Spending, our Interest Program Agreement applies together with these Terms and any other additional documents relevant to your use of the Interest feature.

4. Members Terms and Conditions

4.1 Each Member joins the Group voluntarily when they accept an invitation from the Owner and can leave the Group at any time. By leaving the Group, the Member terminates this Agreement, but any previous actions carried out will remain valid. Members can only join up to 4 Groups via this Service.

4.2 The Member can add funds to the Group; they are only permitted to make transfers from the money in their own Main Account into the Group, but cannot make transfers out of the Group to their own Main Account within their Wise Account.

4.3 The Member cannot share the Group with any other individual and cannot see the Owner’s other funds in their Wise Account.

4.4 The Member must accept these Terms when using the Group Spending feature and is required to inform Wise of the Owner’s death or if the Owner loses their legal capacity, after which, the Customer Agreement will expire.

5. Our Responsibility for Loss or Damage

5.1 Unforeseeable loss or damage. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time this agreement was entered into, both we and you knew it might happen. For example, a specific loss was discussed during the sign-up process.

5.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so.

5.3 We are not liable for business losses. Group Spending is for personal use only, subject to this Customer Agreement, and should not be used for any commercial, trade, or organizational purposes.

5.4 We are not liable for things which are outside of our control. We cannot be liable for our inability to deliver, or delays because of things which are outside our (and our affiliates) control.

5.5 We are not liable for any payments made under this Agreement.

5.6 Disputes between you and a Member relating to your Wise Account or the features are a matter between you and the Member. You recognize that Wise is not a party to any claim or dispute between you and your Members. You agree to indemnify, defend, and hold harmless Wise from any dispute that arises out of the provision of features under these Terms, between you and a Member.

5.7 Because you are bound by the actions of Members, it’s very important that you choose Members carefully. We suggest that you regularly reassess who can be a Member and the Permissions granted to them, including but not limited to ongoing and periodic review of the activity undertaken by Members.

6. General but Important Terms

6.1 No third party rights. These Terms are between you and us. No other person shall have any rights to enforce any of its terms.

6.2 Severability. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

6.3 Governing law. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute between you and us in connection with the Group Spending feature and/or these Terms shall be brought in the courts of the Province of Ontario.

6.4 Language. The parties have agreed that this Customer Agreement and any related documents will be written in the English language. Les parties ont convenu que ce contrat et ses accessoires soient rédigés en anglais.
